Bonnie S. Klapper of Counsel to Clarke Silverglate Law Firm

Miami, Florida (September 2014) Bonnie S. Klapper has become of Counsel to the Brickell law firm of Clarke Silverglate, P.A.. Ms. Klapper served as an Assistant U.S. Attorney first in the Central District of California and later in the Eastern District of New York. While in the Eastern District of New York she prosecuted many of the United States’ most significant money laundering and international drug trafficking cases of the past two decades and was one of the founders, working with Immigration and Customs Enforcement and the Internal Revenue Service, of the El Dorado Task Force, a multi-agency effort to combat narcotics money laundering. Since 2012 Ms. Klapper has been applying her vast knowledge and experience in criminal law to the representation of clients in private practice. Her new of Counsel relationship with Clarke Silverglate will help to enhance the firm’s white collar criminal defense practice.

    Clarke Silverglate Partner Wesley R. Parsons Obtains Reversal of $19.2 Million Jury Verdict

    October 2013 (Miami, Florida) - Clarke Silverglate Partner Wesley R. Parsons recently obtained reversal of a $19.2 million jury verdict in the Florida Fourth District Court of Appeal. Mr. Parsons successfully represented the Florida Department of Agriculture and Consumer Affairs in arguing to the appellate court the trial judge had erred in barring scientific evidence in the damages phase of the 2011 class action trial in Palm Beach County. Upon hearing of the decision, Mr. Parsons said: “We are all about the science. We want the jury to hear the scientific evidence, and we are glad the appellate court agreed the science should be considered.” This victory adds to the list of Mr. Parsons successes in the defense of citrus canker eradication program, operated jointly by the State of Florida and the United States Department of Agriculture from 1995 through 2006.

    Partner Craig Salner Authors Federal Fair Labor Standards Act (FLSA) Reference Compendium

    September 2013 (Miami, FL) - The Defense Research Institute (DRI) has just announced the publishing of the FLSA Collective Action Federal Case Law Compendium, written and edited by Clarke Silverglate, P.A. partner Craig Salner. Mr. Salner is an experienced litigator and an active leader within the DRI Employment and Labor Law Committee.

    In this important publication, Mr. Salner has included an organized summary of each reported federal case from 2009-2012 involving FLSA collective actions cases.  The summaries are broken down by federal circuit, issue, and whether the outcome was favorable to employers, employees, or mixed.  It is intended for FLSA practitioners to have a searchable tool whereby recent cases in their jurisdiction are assembled in one easy to locate place.  Practitioners also can use the compendium to research FLSA claims across jurisdictions.

    Clarke Silverglate Partner Wesley R. Parsons Obtains Successful Ruling on Collection of $27 Million

    September 2012 (Miami, Florida) - A recent decision rendered by the Fourth District Court of Appeal stopped efforts to collect a total of $27.2 million in awards against the State of Florida. Clarke Silverglate, P.A. Partner Wesley R. Parsons successfully represented the State of Florida Department of Agriculture and Consumer Affairs in appealing court orders from Palm Beach County and Broward County in regard to the state’s citrus canker eradication program. The Fourth District Court of Appeal reversed a Palm Beach County order that would have allowed the issuance of a writ of execution to collect from the state. Additionally, the appellate court affirmed a Broward County order blocking such a writ of execution. According to Mr. Parsons, the decision will preserve the orderly administration of citrus canker eradication program claims against the State of Florida.

In 2002, Kat retired and dedicated herself to her most rewarding job to date—motherhood. Their son Cameron is now a high school senior. In retirement, Kat discovered a love of photography and writing and has combined those passions to run a small art and photography venture. She has written and spoken professionally for Great Output Magazine, Rangefinder/After Capture, The Professional Digital Imaging Association and Wedding and Portrait Photographers International. She is also a frequent speaker for the IADC. Kat is currently pursuing a Master’s Degree in Christian studies.

    (Miami)— Clarke Silverglate Partner David Weinstein was sought out by the national media this week, to provide expert commentary on a high-profile murder investigation.  Weinstein appeared on Hardball with Chris Matthews on MSNBC and was quoted in a story in the New York Daily News. 

    Weinstein spoke about the procedures involved in the arrest of George Zimmerman, the neighborhood watch captain who admitted killing 17-year old Trayvon Martin in Sanford, Florida last month.  Zimmerman says he shot Martin in self-defense.

    “I wanted to make sure the public understands the process”, says Weinstein.  “Now that Zimmerman has been charged, there are certain procedures that take place.”

    Before joining Clarke Silverglate, Weinstein was a federal prosecutor and prior to that, a Miami-Dade state attorney.  So, he knows the way the system works and how the lawyers on both sides view the case.  “My 25 years of experience within the system allows me to give people a sense of what the prosecutors approach may be as well as what Zimmerman’s defense team’s strategy might look like.”

    After the shooting, Zimmerman invoked Florida’s controversial Stand Your Ground law, which allows someone who feels threatened in a place he has a right to be, to use deadly force.  “The judge in this case will have to decide if that law merits throwing the case against Zimmerman out,” says Weinstein.  “The fact that the prosecutor filed a second degree murder charge is strategic.  It gives her the opportunity to present evidence regarding the ‘ill will, hatred, spite or evil intent’ that elevated the charge from manslaughter to second degree murder.  It also provides her with the flexibility in plea negotiations to potentially reduce the charge to manslaughter.”

    Clarke Silverglate Wins Directed Verdict for Employer in Harassment Case

    Clarke Silverglate’s client was sued by a former employee for sexual harassment under the Florida Civil Rights Act and retaliation under the Florida Whistleblower Act.  The former employee alleged that her male supervisor sent her a text message containing a naked photo of himself, propositioned her using sexually explicit language and massaged her shoulders.  She claimed that she reported the harassment and was subsequently terminated.  At the close of the plaintiff’s case, the court entered directed verdict for Clarke Silverglate’s client.  In a lengthy opinion, the court reasoned, among other things, that the alleged harassment was not sufficiently severe or pervasive to constitute actionable harassment.  The court also found insufficient proof that the plaintiff availed herself of the company’s preventive and corrective opportunities available to her or that her termination was causally related to a report of harassment.
